Document details fatal Miami hit and run charges, claims

MIAMI, Okla. – An affidavit lays out more details in a fatal hit and run case in Miami, Oklahoma.

The crash happened on February 5, 2022. It claimed the life of 58-year-old Quang Xin Ye, a Chinese citizen living in Miami, Oklahoma.

The Ottawa County Prosecutor’s Office charged Mindy D. McBrien with first-degree manslaughter and leaving the scene of a fatality accident.

Hit and Run

On the night of February 5, around 10:30 pm, Miami 911 Dispatch sent authorities to reports of a man down in the roadway. Police responded to the 1200 block of Steve Owens Blvd, near Vapor Maven.

Police officers got there and found a man who appeared to have been hit by a vehicle. The victim was pronounced dead at the scene.

According to the Miami Police Department, they received several tips from the night of the accident. They also have witnesses and evidence.

Witness Statements

Witness 1

While investigating the hit-and-run, Detective Kelly Johnson, the on-call detective, learned of a vehicle off the roadway on Highway 137. The vehicle was abandoned after it had been wrecked. According to court documents, a detective noticed a pattern transfer in the dust on the hood. The detective felt that the pattern was consistent with the clothes that Ye was wearing.

Authorities seized the vehicle, which was registered to Phillip and Mindy McBrien.

Wyandotte Nation K9 Officer Hamblett and Ottawa County Deputy L. McDaniel were in charge of locating the vehicle owners of the abandoned car.

On the way to the McBrien home, they saw a car going east near the McBrien home. Officer Hamblett turned to get the tag information in case it was somehow related to the case. When they pulled up to the vehicle, the car pulled over off the road and stopped.

An officer walked up to the driver’s door and the driver stated, according to court documents, “Honestly, I wouldn’t even be on this road right now, if I didn’t just help this lady that wrecked her car up here.” He has seen Mindy McBrien off the roadway on Highway 137.

The driver says he didn’t see the accident (on Hwy 137) but pulled up on it after the fact. According to court documents, the driver said the lady was a little drunk.

You can read more about the witness’s statement in the court document here. He told officers he was unaware she had hit a pedestrian until he was told by the officers that stopped and talked to him as he was driving away from the McBrien home.

Witness 2

A second witness described portions of what he saw on Steven Owens Blvd. The witness was driving after work and saw a bike of some sort with a tail light. Later when he looked back there was a vehicle that didn’t move over into the inside lane to go around the bike like he, the witness did. You can read more about his statement in the Court Document.

Notifying the owners of the abandoned vehicle

Officer Hamblett says when they got to the McBrien home, there were lights on and he could see a person moving around. As he got closer, the lights were turned off. Hamblett shined his flashlight into the home and saw a female standing in the dark kitchen staring out the window. He later identified her as Mindy McBrien.

Officer Hamblett wrote in his statement,

“Mindy met us a the front door and we began speaking to her. I asked Mindy if she knew where her vehicel was, and she said it was at her in-laws house. Mindy confirmed she drove a Jeep Cherokeee. While speaking to her at the front door, Phillip arrived. I asked Mindy if she would be willing ot come ot the polcie department with us. She did not immediately answer. While speaking with Mindy and my initial observations of her; she appeard to be intoxiated based upon my training and experience. Mindy displayed the following sins of intoxiation; thick slurred speech, unsteady on her feet, red blood shot eyes, and odor associated with  the consumption of alcoholic beverages coming from her breath.”

Interviewing McBrien

Detective Kelly Johnson planed to interview Mindy McBrien later at the Miami Police Department. He noticed signs of drinking and told Mindy he knew she was intoxicated. According to Court Documents, she shook her head yes in response. Johnson didn’t think it would be fair to interview her while she was intoxicated. They set up a time for the next day but the detective stated she didn’t show up.

Evidence from Vehicle

Authorities executed a search warrant on the Jeep. They collected items including possible blood, hairs, fibers, and paint chips.

Detective Johnson states that he called Phillip to let him know about the search warrant and to get the keys. “Phillip advised that he would et back to me on the keys. Phillip never called me back,” documents state.
