Rape, sexual battery charges filed against SEK music professor

INDEPENDENCE, Kan. – A special prosecutor files formal charges today against an Independence Community College music professor.

Authorities arrested Lawrence Markiewicz more than a week ago for allegations including rape. According to court documents, there are two victims.

His first court appearance was on April 18 via zoom. Judge Gettler ordered a $50,000 surety bond, which Markiewicz has since posted. The Judge also ordered bond supervision by the Court Services Officers as a condition if he posts bond. He can’t have any contact with the alleged victims in this case.

Judge Gettler told the prosecution they had until Markiewicz’s next court appearance on April 26 to file charges. Otherwise, the Court would release him.

Today, April 25, Special Prosecutor David Yoder filed the following formal charges against Markiewicz.

  • Rape; Sexual intercourse without consent and use of force
  • Attempted rape; Sexual intercourse without consent and use of force
  • Aggravated sexual battery; Force or fear
  • Furnishing alcohol or CMB to a minor

Markiewicz has served as Independence Community College’s associate professor of instrumental music since 2018. According to his defense attorney, Markiewicz is on paid administrative leave from ICC.

Alleged Crimes

The alleged crimes took place in Montgomery County, Kansas in March 2022, according to court documents.

Count 1: Rape; Sexual intercourse without consent and use of force

The Complaint states that between March 30 and 31, Markiewicz allegedly had sexual intercourse without the consent of the victim “while she was overcome by force or fear.” Rape is a level 1 Person Felony that has a minimum of 147 months to a maximum of 653 months in prison if found guilty. The victim was at least 21.

Counts 2-4: Attempted Rape, Aggravated Sexual Battery, Alcohol to a Minor

Counts 2, 3 and 4 are crimes allegedly committed by Markiewicz against a second victim. This victim was at least 20.

Documents state that the alleged crime happened between March 30 and 31. Markiewicz allegedly tried to have sexual intercourse without the victim’s consent while she was overcome by force or fear. But the act failed. Attempted Rape is a level 3 Person Felony with a minimum of 55 months to a maximum of 247 months in prison if found guilty.
