Arkansas man arrested after Noel Deputy Marshal pursuit, prosecutor files Felony charges

NOEL, Mo. – Sunday April 10, 2022, a Noel Deputy Marshal conducted a traffic stop on a black Hyundai passenger vehicle displaying wrong plates.

Deputies made contact with the subjects in the vehicle. During the course of the investigation, it was discovered the driver had provided false information, the passenger provided correct information. While the deputy was checking the subjects through dispatch, the passenger exited the vehicle and the driver rapidly accelerated from the traffic stop,” – Noel Marshal’s office

The Noel Deputy Marshal then initiated a pursuit traveling westbound outside the city limits on State Hwy 90 and then onto McDonald County roads. The driver then traveled onto State Route 43 and then onto State Route O with the vehicle crossing into Oklahoma. While Surface was turning onto a Oklahoma road, the driver appeared to throw a dog out of the window of the vehicle. As the vehicle turned onto a gravel road, the driver lost control and did a 180 degree turn facing the deputy. The deputy used his patrol vehicle and pinned the vehicle causing damage to the patrol vehicle but effectively stopping the vehicle pursuit.

After a short foot pursuit he was taking into custody. Discovered the driver had a firearm and alleged illegal narcotics. The driver admitted to ingesting Methamphetamines during the vehicle pursuit.

The driver was transported to an area hospital, treated and released.

Now identified as David Surface, 38, of Arkansas, he is being housed in the McDonald County Jail at Pineville.  The county prosecutor filed charges this week:

  • Possession of a Controlled Substance
  • Operated Vehicle on Highway without a Valid License
  • Felony Resisting Arrest

Surface bond has been set at $3,000.00 cash only.

Sgt T. Sheppard of the Noel Marshals office updates the dog that was tossed out the window was not injured. It was recovered and returned to the owner.
